These Terms of Service ("Terms") govern your access to and use of the AE Smart Card website, smart cards, and related services (collectively, the "Services") provided by AE Smart Card ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

1. Account Registration

To access certain features of our Services, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Smart Card Usage

2.1 Purchasing a Smart Card

Smart cards can be purchased at our designated sales points, authorized retailers, or through our website. A one-time card fee applies to all new cards, as specified at the time of purchase. This fee is non-refundable.

2.2 Loading Credit

Credit can be loaded onto your smart card at authorized reloading stations, through our website, or via our mobile application. We reserve the right to set minimum and maximum loading amounts, which may be changed from time to time without prior notice.

2.3 Card Validity

Standard smart cards are valid for five (5) years from the date of purchase. Tourist passes are valid for the duration specified at purchase (1-day, 3-day, or 7-day). The expiration date is printed on the card or can be viewed through your online account.

2.4 Card Usage

Your smart card must be tapped on the card reader when boarding and, where applicable, when exiting a bus. Failure to tap your card may result in being charged the maximum fare or being subject to a penalty fee. You must have sufficient credit on your card to pay for the fare.

2.5 Lost or Stolen Cards

If your card is lost or stolen, report it immediately by calling our customer service or through your online account. If your card is registered, we can block the lost card and transfer the remaining balance to a replacement card, subject to a replacement fee.

2.6 Refunds

Refunds for unused credit on smart cards are subject to our Refund Policy. Administrative fees may apply.

3. Payment Terms

By providing a payment method in connection with our Services, you represent that you are authorized to use the designated payment method and you authorize us to charge your payment method for any purchases you make. Payment processing services are provided by third-party payment processors and are subject to their terms of service.

4. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may access, use, and display our Services on a computer or mobile device and download and print content only for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.

To the fullest extent permitted by applicable law, in no event shall AE Smart Card or its affiliates, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, our Services, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

You agree to defend, indemnify, and hold harmless AE Smart Card and its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our Services.

8. Termination

We may terminate or suspend your access to all or part of our Services, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users of our Services, us, or third parties, or for any other reason. We have the right to investigate violations of these Terms and any conduct that affects our Services.

9. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes.

10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to these Terms or our Services shall be instituted exclusively in the courts located in Abu Dhabi, United Arab Emirates.

11. Miscellaneous

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

These Terms, our Privacy Policy, and any terms disclosed and agreed to by you when using specific features of our Services constitute the sole and entire agreement between you and AE Smart Card with respect to our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to our Services.
